29 CFR  1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) On or about June 1, 2022, the employer did not ensure that all employees who were required to wear tight-fitting respirators while conducting normal job operations were medically evaluated prior to use of the respirator.   Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:   (a) On or about June 1, 2022, the employer did not ensure that employees using a tight-fitting facepiece respirator (N95) were fit tested prior to initial use.  Employees were issued and required to utilize N95 respirators due to COVID-19 Community Spread Levels, and while providing care to residents exhibiting symptoms of COVID-19, without fit testing or medical evaluation  prior to initial use.  This condition exposed employees to respiratory hazards and health hazards associated with COVID-19.

The employer allowed the use of relocatable power taps that were connected in series (daisy chained) for use in providing power to multiple electrical devices. The employer did not train employees on the written hazard communication program.  The employees used chemicals for housekeeping activities and facility maintenance:  Chemicals in the workplace included, but were not limited to the following:  1.  Liquid Oxygen (flammable, oxidizer, cryogenic burns to skin or eyes) 2. Unleaded gasoline (flammable, irritant to skin or eyes) 3. Lime-away (corrosive to skin or eyes) 4. Ultra San (corrosive to skin or eyes) 5. Oasis  XP115 (corrosive to skin or eyes) 6. Liquid Assure (corrosive to skin or eyes) 7. VirexTB, Ready-to-Use Disinfectant Cleaner (Health Hazard, repeated exposure, organ toxicity, irritant to skin or eyes) 8. Virex II 256, One-Step Disinfectant Cleaner and Deodorant Quat Based Disinfectant (Health Hazard, corrosive to skin or eyes, respiratory irritant)
