29 CFR  1910.28(b)(1)(i):The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system:  a)  On or about 06/02/2022, at the Food Town Grocery Store at 4390 Buffalo Road, located in North Chili, New York, the employer did not enforce the use of fall protection for employees performing maintenance on an HVAC unit,  20 feet above lower levels.  Employees were allowed to work on elevated surfaces without fall protection.  NO ABATEMENT CERTIFICATION REQUIRED
