29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  a) 2080 Terry Rd, right side of house: On or about June 8, 2022 and times prior, an employee used a fabricated frame scaffold to paint the side of a residential home. The employee worked from the 4th buck of the scaffold that was only equipped with one plank and exposed the employee to a fall of 24 feet.   b) 2080 Terry Rd, right side of house: On or about June 8, 2022 and times prior, an employee used a fabricated frame scaffold to paint the side of a residential home. The employee worked from the 3rd buck of the scaffold that was only equipped with one plank and exposed the employee to a fall of 15 feet.

29 CFR  1926.451(c)(2):Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates and mud sills or other adequate firm foundation:  a) 2080 Terry Rd Right Side: On or about June 8, 2022, an employee worked from a fabricated scaffold to paint the side of a residential house.  The employee was exposed to a potential scaffold collapse due to the  scaffold poles resting directly on wood, concrete and cinder block instead of a base plates.

29 CFR  1926.451(f)(7):Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:  a) 2080 Terry Rd Right side: On or about June 8, 2022 and times prior,  a fabricated frame scaffold was erected so an employee can paint the right side of a residential home. The scaffold was not erected by   a competent person qualified in scaffold erection in that the scaffold was not fully planked, guard rails were not in place, and base plates did not rest on a solid/firm foundation.

29 CFR  1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) 2080 Terry Rd Right Side Top Tier: On or about June 8, 2022 and times prior, an employee used a  fabricated frame scaffold to paint the side of a residential home. There were no guardrails installed on the 4th buck of the scaffold and personal fall protection was not used exposing the employee to falls up to 24 feet.  b)2080 Terry Rd Right Side  Middle Tier: On or about June 8, 2022 and times prior, an employee used a  fabricated frame scaffold to paint the side of a residential home. There were no guardrails installed on the 3rd buck of the scaffold and personal fall protection was not used exposing the employee to falls up to 15 feet.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a) 2080 Terry Rd Right Side: On or about June 8, 2022 and times prior, an employee painted the side of a residential home from a fabricated frame scaffold that was not fully planked, had no means of fall protection and was not equipped with base plates. The employee was not trained to recognize the hazards associated with working from scaffolds that were not properly erected.
