29 CFR 1926.20(b)(2): The employer did not ensure that frequent and regular inspections of the job sites, materials, and equipment were conducted by a competent person:  a) On or about 6/3/2022 at a rehabilitation project located at 3310 Southwestern Boulevard, Orchard Park, New York; frequent and regular inspections were not completed to evaluate work conditions and methods to ensure that employees were protected from falls and collapse hazards when removing and replacing a standing seam metal roof.  Employees were exposed to a 12 feet 6 inches falls to concrete floor below.  ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) On or about 6/3/2022 at a rehabilitation project located at 3310 Southwestern Boulevard, Orchard Park, New York; employees were not instructed to recognize and avoid hazardous conditions such as, but not limited to, falls and collapse hazards when removing and replacing a standing seam metal roof. The employees were also not instructed in the regulations applicable to the work being performed to control or eliminate the numerous hazards.  ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident:  a) On 6/4/2022; where an employee died after falling through a roof of a one-story commercial building while replacing a standing seam roof. The employer did not notify OSHA of the death. OSHA became aware of this fatality by the Orchard Park Police Dept. on 6/8/2022.  NO ABATEMENT CERTIFICATION REQUIRED
