29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  On or about August 2, 2022, and at times prior, in the production facility, where the employer had not administered a hearing conservation program for employees exposed to noise that had exceeded an 8-hour TWA of 85 dBA, based on an 80 dB threshold:  (a) A production employee conducting trimming operations was exposed to continuous noise levels at 198% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 198% is approximately 94.9 dBA. Sampling was performed for 444 minutes during one shift. Zero exposure was assumed for the 36 minutes not sampled;  (b) A production employee conducting grinding and drilling operations was exposed to continuous noise levels at 68% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 68% is approximately 87.2 dBA. Sampling was performed for 447 minutes during one shift. Zero exposure was assumed for the 33 minutes not sampled.  American Acrylic & Injection, Inc. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.95(c)(1) which was contained in OSHA inspection number 1529213, citation number 1, item number 1, and was affirmed as a final order on October 19, 2021, with respect to a workplace located at 419 Welch Drive, Farmersville, Texas 75442.

This limit has been established to prevent irritation of eyes, skin, nose, throat, breathing difficulty.  The exposure is derived from one sample collected over a 405 minute period.
