29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  Employees are exposed to chemical hazards.  At the jobsite located at 17804 England St. Overland Park, Kansas, employees engaged in swimming pool construction activities were exposed to dermal, ingestion, and inhalation hazards from exposure to concrete dust, Pool Time 3'' Tablets Stab Chlorinator, unleaded gasoline and Masonry Cement Mortars. The employer had not developed and implemented a hazard communication program.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   Employees were exposed to chemical hazards.  At the jobsite located at 17804 England St. Overland Park, Kansas, employees engaged in swimming pool construction activities were exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals without being provided with information and training on how to recognize, avoid and/or eliminate the hazards associated with the Pool Time 3'' Tablets Stab Chlorinator, unleaded gasoline and Masonry Cement Mortars.

Employees were exposed to silica hazards.  At the jobsite located at 17804 England St. Overland Park, Kansas, employees engaged in swimming pool construction activities, dry cutting on concrete, were exposed to silica hazards. The employer failed to implement engineering and work practice controls as outlined in Table 1 to reduce employee exposure to silica dust.
