29 CFR  1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Worksite was located at 413 Swedesboro Road, Mullica Hill, NJ 08062.  The employer did not develop or implement a written hazard communication program.   Employees work with hazardous chemicals including but not limited to diesel, gasoline, kerosene and motor oils.  Violation occurred on or about June 15, 2022.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:  a) Worksite was located at 413 Swedesboro Road, Mullica Hill, NJ 08062.  The employer did not maintain safety data sheets for the hazardous chemicals used in their daily processes which handles such chemicals but not limited to No. 1 and No. 2 Diesel Fuels, Unleaded Automotive Gasoline, Mobil 1 5W-30 and Mobil 1 10W-30 motor oils.  Violation occurred on or about June 15, 2022.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The employer did not provide an effective training program for hazard communications for the company.  Violation occurred on or about June 15, 2022.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR  1910.252(a)(3)(i):  Welding, cutting, or other hot work was performed on used drums, barrels, tanks, or other containers that had not been cleaned so thoroughly as to make absolutely certain there were no flammable materials present:  a) Workplace - 413 Swedesboro Road, Mullica Hill, NJ 08062:  Workers welded on a tanker truck that contained fuel including diesel that was possibly mixed with gasoline.  The tanker truck was not adequately cleaned to remove the fuel and vapor. Violation occurred on or about June 15, 2022.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
