29 CFR  1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s)  a.  Fabrication Shop: On or about June 16, 2022 and at times prior, the employer exposed employees to powered industrial truck hazards, in that the left rear tire of the "Hyster" forklift (serial number K005V05177A) was in need of replacement, the forklift was leaking fluids and the gauge(s) were not functioning properly.

29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a.  Chemical Room:  On or about June 16, 2022, and at times prior, the employer exposed employees to chemical hazards in that the employer did not develop a written hazard communication program for employees who use chemicals including, but not limited to, diesel fuel, hydraulic fluid, Pico lubricant, DEF fluid compressed acetylene and compressed oxygen in the performance of assigned duties.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a.  Throughout the facility: On or about June16, 2022 , and at times prior, the employer exposed employees to chemical hazards, in that the employer did not provide hazard communication training to employees who use chemicals including, but not limited to,  diesel fuel, hydraulic fluid, Pico lubricant, DEF fluid compressed acetylene and compressed oxygen in the performance of assigned duties.
