29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a) On or about 6/14/2022 at a roof project located at 2 North Street, Batavia, New York; employees were using a boom lift to access work areas while replacing shingles on a roof. The employees in the lifts did not have a harnesses with lanyards attached to the boom or basket.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) On or about 6/14/2022 at a roof project located at 2 North Street, Batavia, New York; employees were replacing the roof of a two story building. The roof had an 6 in 12 pitch and an eave height of approximately 22 feet. There was no fall protection in use.  NO ABATEMENT CERTIFICATION REQUIRED
