29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)Perez Tile Loading LLC at 106 Sandstone Avenue, Brandon, SD 57005:  On or about and at times prior to June 21, 2022, the exposing employer did not ensure that employees were protected from flying particles associated with operating pneumatic nail guns while conducting roofing operations on a commercial property.  This condition exposed employees to eye injuries including the introduction of foreign particles into the eye.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  (a)Perez Tile Loading LLC at 106 Sandstone Avenue, Brandon, SD 57005:  On or about and at times prior to June 21, 2022, the exposing employer did not ensure that employees were protected from falls while conducting roofing operations on a steep-slope commercial property.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) Perez Tile Loading LLC at 106 Sandstone Avenue, Brandon, SD 57005:  On or about and at times prior to June 21, 2022, the employer did not ensure that the ladder being used for access to the first story work surface and the roof of the steep-slope commercial property on the northwestern site were extended at least three feet above the upper landing surface.  This condition exposed employees to fall hazards associated with ladder access.
