29 CFR  1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l):  a)Precision Framing LLC at 7800 Western Avenue South, Sioux Falls, SD 57108: On or about and at times prior to June 22, 2022, the employer did not ensure employees were protected from stuck-by hazards in that not all forklift operators were trained, evaluated and certified by the employer prior to operating forklifts on site.  This condition exposed employees to struck-by hazards associated with improper forklift usage.

29 CFR  1910.178(m)(5)(ii): A powered industrial truck was left unattended when the operator was 25 ft. or more away from the vehicle which remains in his view, or whenever the operator left the vehicle and it was not in his view:   a)Precision Framing LLC at 7800 Western Avenue South, Sioux Falls, SD 57108: On or about and at times prior to June 22, 2022, the employer did not ensure employees were protected from stuck-by and crush-by hazards in that a forklift was left unattended with a suspended load and the operator was greater than 25 feet from the vehicle.  This condition exposed employees to struck-by hazards associated with stock falling from the forks as well as unexpected movement or failure of the forklift.
