OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with being crushed or struck by falling objects: Small Freezer (minus 5 degrees Fahrenheit): The commercial steel storage racks used to store pallets of frozen foods were not maintained to prevent collapse of the racks. Deficiencies included but were not limited to: a) Aisle 9 - Bottom horizontal support beams of the overhead storage rack that spanned a main aisle were damaged. b) Loading capacity of the storage racks had not been determined and labeled accordingly.

29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse: Warehouse: The following materials were not adequately stacked, tiered and/or limited in height to prevent sliding and collapsing: a) Dry Dock area, adjacent to Dock Door #9 - pallets of bagged product were stacked 2 pallets high were unstable and leaning into the aisle. b) Thawing Area - pallets of previously frozen food were stacked 2 or more pallets high were unstable and leaning into the aisle. c) Big Freezer along main front aisle - stacks of pallets of frozen food such as croissant stuffers, cheeseburgers and shrimp were unstable and leaning into the aisle.
