Employees were exposed to respiratory hazards from Asphalt Aluminum Premium roof coating (containing mineral spirits, aluminum powder stabilized, naphtha hydrotreated heavy, solvent naphtha light aromatic, synthetic amorphous silica), which was being used to spray coat an agricultural barn roof during the time of the inspection.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area (Construction Reference: 1926.59):  On or about June 27, 2022 the employer Ed, Brad & Grant Riley, at worksite located at 4904 Mulligans Bluff, Ney OH 43549, did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard is present. The employer did not provide information and training designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Employees were exposed to respiratory hazards from Asphalt Aluminum Premium roof coating (containing mineral spirits, aluminum powder stabilized, naphtha hydrotreated heavy, solvent naphtha light aromatic, synthetic amorphous silica), which was being used to spray coat an agricultural barn roof during the time of the inspection.

Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  On or about June 27, 2022 the employer Ed, Brad & Grant Riley, at worksite located at 4904 Mulligans Bluff, Ney OH 43549, did not ensure that employees are adequately protected from fall hazards while conducting construction roofing activities on an agricultural barn roof peak. Employees were exposed to approximately 25 feet fall or higher fall hazards from the roof of the structure to the ground below. Employees were working atop a steep roof with a 8:12 at the peak of the roof, and 12:12 on the steep sides of the roof.
