29 CFR  1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  On or about June 27, 2022, in the North Building of the facility located at 500 Industrial Drive, Elkhart Lake, WI,  three CTD Machines Model M225 Miter Cutoff Saw Serial numbers 3703, 3732 and 4440 allowed access to the saw blade cutting area while cutting vinyl and aluminum edging. Each side of the saw blade is accessible through a 3.5 inch high by 5 inch wide opening on both sides of the saw blade in front of the fence.

29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  On or about June 27, 2022, at the facility located at 500 Industrial Drive, Elkhart Lake, WI, the written Hazard Communication Program was not updated for the new requirements related to the United Nations Globally Harmonized System of Classification and Labeling of Chemicals  adopted by the 2012 Hazard Communication update.

29 CFR  1910.1200(f)(6): Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: (i) The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, (ii) Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:  a) On or about June 27, 2022, in the Combo Assembly Area of the facility located at 500 Industrial Drive, Elkhart Lake, WI, an one gallon container and a re-used Windex spray bottle containing Drawsol WM 4740 Punch Press Die Lubricant were not labeled with the identity and associated hazards of its contents. b) On or about June 27, 2022, in the Assembly Area of the facility located at 500 Industrial Drive, Elkhart Lake, WI, a squirt bottle containing acetone was  not labeled with the identity and associated hazards of its contents. c) On or about June 27, 2022, in the Assembly Area of the facility located at 500 Industrial Drive, Elkhart Lake, WI, pump containers containing ACRYL-R SM5504 Acrylic Self-leveling Sealant (clear and white) were not labeled with the identity and associated hazards of its contents.

29 CFR  1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets:  On or about June 27, 2022, at the facility located at 500 Industrial Drive, Elkhart Lake, WI, employees exposed to carbon monoxide levels high enough for carbon monoxide monitors to alarm two times in June 2022 were not trained on the hazards and health symptoms associated with carbon monoxide exposure.

29 CFR  1904.41(a)(2): Annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. If your establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form.  On or about March 2, 2022, the establishment located at 500 Industrial Drive, Elkhart Lake, WI, had not electronically submitted the information from the 2021 OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA.
