29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8  m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  On or about July 12, 2022, employees were exposed to fall hazards while conducting framing/decking work on the 3-story deck of a new construction build of a multi-family residential building without utilizing a fall protection system. The third deck, that was being built at the time, had a ground to upper deck height of approximately 23 feet.  b) On or about July 12, 2022, employees were not protected from fall hazards of approximately 13 feet to the ground while working near unprotected wall openings.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
