29 CFR  1926.100(a):Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a) Blackburns Chimney Sweep, Inc. DBA Blackburn's Chimney Services located at 2309 Dorset Rd, Upper Arlington, OH 43221:  On and preceding July 14, 2022, the employer did not ensure that employees were protected by protective helmets while working in an area with overhead hazards including but not limited to a brick tong which fell off of the scaffold near the employee.  A masonry crew member was working on ground level beneath a three-tier scaffold assisting with hoisting up materials and was not wearing head protection thereby exposing the employee to struck-by hazards to the head.

DBA Blackburn's Chimney Services located at 2309 Dorset Rd, Upper Arlington, OH 43221:  On and preceding July 14, 2022, the employer did not ensure that all working levels of the scaffold was fully planked or decked between the front uprights and the guardrail supports. A masonry crew was working on a three-tier scaffold approximately 16 feet above ground level with a single plank/platform on each level of the scaffolding thereby exposing employees to fall hazards.

DBA Blackburn's Chimney Services located at 2309 Dorset Rd, Upper Arlington, OH 43221:  On and preceding July 14, 2022, the employer did not install guardrail systems along all open sides and ends of scaffolding platforms at heights up to 16 feet. A scaffolding platform that was in use for masonry work on a multi-story residential home did not have guardrails installed thereby exposing employees working on scaffolding to falls up to 16 feet.

29 CFR  1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section:  1926.451(h)(2)(i): The area below the scaffold to which objects can fall shall be barricaded, and employees shall not be permitted to enter the hazard area; or  1926.451(h)(2)(ii): A toeboard shall be erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below, except on float (ship) scaffolds where an edging of 3/4 x 1 1/2 inch (2 x 4 cm) wood or equivalent may be used in lieu of toeboards   a) Blackburns Chimney Sweep, Inc. DBA Blackburn's Chimney Services located at 2309 Dorset Rd, Upper Arlington, OH 43221:  On and preceding July 14, 2022,  the employer did not ensure employees working below a scaffold were protected from fallings tools, materials, or equipment. A masonry crew was working on a three-tier scaffold approximately 16 feet above ground level with tools on the platform. The area beneath the sections where work was being performed was not barricaded nor were there toeboards in place to prevent tools and materials from falling to the ground thereby exposing employees to struck-by hazards.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Blackburns Chimney Sweep, Inc. DBA Blackburn's Chimney Services located at 2309 Dorset Rd, Upper Arlington, OH 43221:  On and preceding July 14, 2022, the employer did not ensure that employees were protected from falls while working on a roof of a two story residential home.  A masonry crew was working on a chimney on the roof of a home at heights up to 17 feet at the eave. The employees were not utilizing a personal fall arrest system, guardrails or any other means of fall protection thereby exposing employees to falls up to 17 feet.
