OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards in tree removal operations.  On or about July 14, 2022, at a jobsite located at 570 Abilene Trail, Wyoming, Ohio, employees were exposed to fall hazards from the decayed tree and hazards of being struck-by the falling decayed limbs and trunk while engaged in tree removal activities.  The employer did not conduct an assessment to determine the extent of tree decay for four trees scheduled for removal prior to a worker climbing the trees.  Among other methods, one feasible and acceptable means of abatement would be to follow the national consensus standard guidelines of the American National Standards Institute, ANSI Z133-2017 Safety Requirements for Arboriculture Operations and before beginning any tree removal operation, the chain saw operator and/or crew leader shall carefully consider relevant factors pertaining to the tree and site and shall take appropriate actions to ensure a safe removal operation. Factors to include may be, but are not limited to, tree decay, tree lean, and wind.
