OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from fall and struck by hazards: Site- Two employees working from a 2630ES JLG scissor lift were not protected from fall and struck by hazards where one of the employees was sitting and standing on the outside of the scissor lift guardrails while operating a Makita demolition hammer. The employee operating the Makita demolition hammer was side loading the JLG scissor lift in which the employee was connected to the guard rail of the scissor lift with a personal fall arrest harness and lanyard. The JLG scissor lift was subject to tipping over due to the employee standing and sitting on the outside of the scissor lift guardrail and side loading the scissor lift while operating the Makita demolition hammer.
