(b) Second level, west leading edge: Employees engaged in decking subfloor and traveling between the forklift platform and the edge of the deck did not have fall protection in place. 29 CFR 1926.1053(b)(1):Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. (a) Three employees were using a Werner fiberglass A-Frame step ladder to access the second floor deck 119 inches above the lower level. The ladder had a broken top, was not secured in any way, and workers had to step approximately 2 feet to and from the top to the deck. NOTE: Corrected during inspection.

29 CFR 1926.1053(b)(16):Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. (a) Employees engaged in framing activities used a Werner 8-foot fiberglass A-frame step ladder to access the second level decking. The plastic top was broken with a section missing. The ladder had not been removed from service or marked with DoNot Use or similar. NOTE: Certification of corrective action (abatement) is required for this item.
