29 CFR  1910.132(d)(1):The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  On or about July 28, 2022 the employer did not ensure that a hazard assessment of the facility and work areas of employees had been performed in order to determine necessary PPE requirements to protect employees. Hazards present in the workplace include  the need for foot protection, eye protection, head protection, and hearing protection.

29 CFR  1910.135(a)(1):The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  On or about July 16, 2022 the employer did not ensure that employees tasked with working the rail and paint area of the facility were provided with or utilized head protection while working in the area. Employees are exposed to overhead hazards of hanging attachments such as but not limited to hooks and chains in the above head rail/ trolley area as well as material handling devices.
