29 CFR  1926.104(a): The employer did not ensure that  any lifeline, safety belt, or lanyard actually subjected to in-service loading, as distinguished from static load testing, shall be immediately removed from service and shall not be used again for employee safeguarding.  a)Site located at 4285 NY-31, Clay, NY 13041: On or about 7/28/2022, the employer did not prevent employee exposure to fall hazards when employees utilized a lanyard anchored to the roof had been subjected to a fall (lanyards shock absorber stitching had been torn open).

29 CFR  1926.451(b)(1)(i): The employer did not ensure that each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide.  a) Site located at  4285 NY-31, Clay, NY 13041: On or about 7/28/2022, the employer did not prevent possible exposure to fall hazards when a roof scaffold with a gap of 4-6 inches between adjacent platforms was constructed onsite and utilized by employee(s) during siding installation activities.

29 CFR  1926.1053(b)(1): Employer did not ensure that the portable ladders used for access to the upper landing surface had ladder side rails that extended at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.  a) Site located at 4285 NY-31, Clay, NY 13041: On or about 7/28/2022, the employer did not provide ladders for roof access that were 3 feet above the upper landing surface, exposing workers to falls of greater than 10 feet.

29 CFR  1926.451(g)(1)(vii): 29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1m) above a lower level, not otherwise specified in paragraphs (g)(1)(I) through (g)(1)(vi) of this section, was not protected from falling to that lower level by use of personal fall arrest systems or guardrail systems meeting the requirement of paragraph (g)(4) of this section:  a) Site located at 4285 NY-31, Clay, NY 13041: On or about 7/28/2022, the employer failed to prevent employees exposure to fall hazards when employee(s) utilized a roof scaffold without guardrails or the use of a personal fall arrest system.  EXTERIOR INNOVATIONS PREVIOUSLY RYAN LAFAVE DBA EXTERIOR INNOVATIONS was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501 (B)(13)), which was contained in OSHA inspection number 1215544, citation number 1, item number 2 and was affirmed as a final order on 12/18/2017, with respect to a workplace located at 748 Beech street, Syracuse, NY 13209.
