Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system. The Employer is failing to protect employees from fall hazards. This was most recently documented on or about June 28, 2022 at a residential construction jobsite located at 19258 Ruggles Circle, Elkhorn, Nebraska. Employees were standing on the finished OSB of the residential second level structure at heights over 6 feet subjected to fall hazards and not utilizing any form of fall protection.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. The employer failed to protect employees from fall hazards. This was most recently documented on or about June 28, 2022, at 19258 Ruggles Cir. Elkhorn, Nebraska. An extension ladder was used for access and egress to the upper level of the residential structure and it did not extend at least 3 feet above the surface being accessed.
