29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) On or about July 27, 2022, at a new residential construction site located at 2600 74th Avenue South, in Fargo, North Dakota, an employee working in close proximity to someone operating pneumatic nail guns at approximately 120 psi and was exposed to eye and face hazards from flying particles while working on a residential roof without wearing impact resistant eye or face protection.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  (a) On or about July 27, 2022, where an employee was engaged in roofing activities on a residential construction site located at 2600 74th Avenue South, in Fargo, North Dakota, the employee was exposed to fall hazards greater than 6 feet without a fall protection system in place.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access:  (a) On or about July 27, 2022, at a residential construction site located at 2600 74th Avenue South, in Fargo, North Dakota, the employee was allowed to continually use a ladder that did not extend three or more feet above the landing surface while installing roofing shingles.
