29 CFR  1926.451(f)(3):Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity as per reference 1910.27(a).  BASKETBALL GYMNASIUM:  On or about August 2, 2022, the employer had not conducted inspections on the Tallescope Upright scaffold prior to an employee using it to perform vent cleaning with a vacuum resulting in a fatal fall.

29 CFR  1926.452(i)(4): Outrigger beams were not secured in place against movement, and were not braced at the fulcrum point against tipping as per reference 19.27(a).   BASKETBALL GYMNASIUM:  On or about August 2, 2022, the employer did not ensure that the Tallescope scaffold was equipped with outrigger beams to prevent any movement during use and that the locking hooks at the base of the ladder were securely locked in place to prevent tipping at the fulcrum point.

29 CFR  1926.452(i)(6): The entire supporting structure was not securely braced to prevent any horizontal movement as per reference 1910.27(a):   BASKETBALL GYMNASIUM:   On or about August 2, 2022, the entire supporting structure of the Tallescope scaffold was not securely braced to prevent any horizontal movement during use. All casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold was used in a stationary manner.

WORKSITE/BASKETBALL GYMNASIUM:  On r about August 2, 2022, the employer had not provided the employees operating the Tallescope Upright scaffold with training to recognize the hazards associated with the scaffold.
