29 CFR 1926.150(c)(1)(vi): A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas were being used on the jobsite: a- 370 Stokes Road, Medford NJ: Company workers were exposed to fire hazards when a portable fire extinguisher was not available at the worksite when more than 5 gallons of gasoline were being used. Condition observed on or about 08/05/22. NOTE: IN ADDITION TO ABATEMENT DOCUMENTATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: a- 370 Stokes Road, Medford NJ: Workers were not protected from falling when walking and working from the top plates of a structure's first floor wall frames while wearing full body harnesses with one end of a lanyard attached to it and the other end tied to the top chord of a floor joist. At the time of the inspection, the length of the lanyard and the top chord (designated as the anchor) would not have prevented these workers from falling. As such, these workers were exposed to fall hazards up to and in excess of 9 feet to the surface below. Condition observed on or about 08/05/22. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a - 370 Stokes Road, Medford NJ: Workers were exposed to fall hazards, up to and in excess of 9 feet to the ground surface, when performing floor joist installation and other related activities while walking and working from a structure's outer wall frame's top plates while wearing full body harness that were attached to lanyards that were too long and not attached to a proper anchor point that would have prevented them from falling nine feet. At the time of the exposures these company workers had not received fall hazard recognition and minimization training. Condition noted on or about 08/05/22. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
