29 CFR  1926.1153(c)(1):Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) At the jobsite located at 5359 E Hope St., Post Falls, ID, on 08-04-2022, the employer failed to ensure controls were in place for employees cutting Fiber Cement siding with a handheld circular saw without an integrated water delivery or dust collection system.

29 CFR  1926.1153(g)(1): The employer did not establish and implement a written exposure control plan:  a) At the jobsite located at 5359 E Hope St., Post Falls, ID, on 08-04-2022, the employer failed to establish and implement a written exposure plan for the protection of employees cutting fiber cement siding containing crystalline silica.  Workers were using a handheld circular saw without an integrated water delivery or dust collection system.  NOTE: Certification of corrective action (abatement) is required for this item.

29 CFR  1926.1153(i)(1): The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200):    a) The employer failed to include fiber cement siding containing crystalline silica in their hazard communication program.  The employer did not have a safety data sheet (SDS) or training for crystalline silica containing fiber cement siding.   Employees were cutting fiber cement siding with a handheld circular saw without an integrated water delivery or dust collection system.  NOTE: Certification of corrective action (abatement) is required for this item.
