Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level had not been protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about July 27, 2022, employees of HP Flores Construction, LLC DBA HP Flores were working on the third-floor deck of a senior living facility being constructed at 16255 Chesterfield Parkway West in Chesterfield, Missouri. Twelve employees were permitted to work without guardrails, safety nets, or personal fall arrest systems while working near an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level.
