29 CFR  1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:  a) Roof: On or about August 10, 2022, and at times prior, the employer exposed employees to struck-by hazards, in that safety glasses were not provided to employees while using pneumatic nail guns to secure roofing shingles.

29 CFR  1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:   a)  Adjacent to the church: On or about August 10, 2022, and at times prior, the employer exposed employees to fall hazards, in that written approval from the manufacturer of a "MAGNI AMERICA, LLC."  RTH model 6.39 rotating telescopic handler (number 10986339) was not obtained for attachment of a wooden box  to the forks of the RTH 6.39 and used to  lift employees approximately 50 feet above the ground to access the roof.
