29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard. On August 11, 2022, employees engaged in grain handling activities at the Seaboard Foods facility located at 132 N. County Rd. 14, Leoti, Kansas were exposed to fall hazards in the receiving area, where the employer is failing to provide employees with training in the recognition of fall hazards and use of fall protection equipment prior to having exposure to fall hazards. Instances of exposure to fall hazards include but are not limited to: 1. Employees without fall protection accessing the top hatch of hopper railcar approximately 15 feet above the lower working level. 2. Employees without fall protection exposed to an approximate 8-foot fall hazard from the grate opening to the auger at a lower level.

County Rd. 14, Leoti, Kansas were exposed to fall hazards in the receiving area, where the employer is failing to prevent employee exposure to fall hazards associated with hopper railcar unloading of grain products. Instances include but are not limited to: 1. Employees without fall protection accessing the top hatch of hopper railcar approximately 15 feet above the lower working level. 2. Employees without fall protection exposed to an approximate 8-foot fall hazard from the grate opening to the auger at a lower level.
