29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: a. On or about August 17, 2022, an employee was exposed to continuous noise levels at 72.25% of the permissible daily exposure (8-hour, time-weighted average sound level of 90 dBA or equivalently, a dose of 100 percent), during the 420 minute sampling period. Exposure calculations include a zero increment for the 60 minutes not sampled. The employer failed to institute a training program and ensure employee participation in the program for those employees exposed to noise levels measured to be above the action level of 50% of the permissible daily exposure. b. On or about August 17, 2022, an employee was exposed to continuous noise levels at 67.31% of the permissible daily exposure (8-hour, time-weighted average sound level of 90 dBA or equivalently, a dose of 100 percent), during the 374 minute sampling period. Exposure calculations include a zero increment for the 106 minutes not sampled. The employer failed to institute a training program and ensure employee participation in the program for those employees exposed to noise levels measured to be above the action level of 50% of the permissible daily exposure.

29 CFR 1910.1026(d)(1): The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted average exposure for each employee exposed to chromium (VI): On or about November 1, 2022, the employer failed to determine the 8-hour time-weighted average (TWA) exposure for each employee exposed to chromium (VI) when welding the stainless steel skins onto 42 inch plows in the muni cell. An employee that did part of this operation, tack welding for part of the day, was determined to be exposed to 0.6 �g/m3 of hexavalent chromium as an 8-hour TWA.
