29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Outside scrap staging & baling area and shear operations of All American Alloys and Recycling, Inc., 200 South First Street, Elizabeth, NJ;  On or about 2/18/2022 and thereafter, the employer failed to provide annual audiometric testing and training as part of a hearing conservation program to employee(s) exposed to metal-on-metal impact noise from handling of scrap copper & aluminum, including skidsteer scooping and dumping, baler loading & crushing operation, and sorting & shearing of scrap. Personal monitoring measured exposures of a skidsteer operator feeding the HRV baler to noise at 150% and a shear operator at 67% Dose; equivalent to 8-hour Time-weighted averages (TWA) of 92.9 dBA and 87.1 dBA respectively.
