29 CFR  1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a) Bass Pro Shops, Main Entrance - On or about August 15, 2022, an employee was operating a JLG 1200SJP Mobile Elevated Work Platform, at working heights of in excess of 18 feet above grade without utilizing any means of a personal fall arrest system.    b) Bass Pro Shops, Boat Showroom Side - On or about August 15, 2022, an employee was operating a JLG 800A Mobile Elevated Work Platform, at working heights of approximately 20 feet above grade without utilizing any means of a personal fall arrest system.  No abatement certification required.

29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) Bass Pro Shops, Harrisburg Mall, Main Entrance - On or about August 15, 2022, an employee was working on a steeply sloped roof performing restoration work, between 14 to 20 feet above grade, without utilizing any means of fall protection.    No abatement certification required.
