Eatery failed to provide documentation demonstrating the abatement methods and completion as cited in Citation 1 Items 1a/b: 1) The employer did not have a written hazard communication program and employees were exposed to hazardous chemicals and 2) The employer did not provide hazard communication training to employees.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in paragraphs (f), (g), & (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes items (i) and (ii) of this subparagraph. On or about August 16, 2022, the employer failed to ensure that a written hazard communication program had been developed and implemented. Employees were exposed to chemicals including, but not limited to, carbon monoxide produced by the retherm machines.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area. On or about August 16, 2022, the employer failed to ensure employees exposed to elevated levels of carbon monoxide, produced from the retherm machines, were provided effective information and training on hazardous chemical in their work area.
