29 CFR  1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered.  (a) DM Sabia & Company, Inc. Jobsite located at 1 N. 19th Street Philadelphia, PA 19103. The employer did not administer an effective hearing conservation program. Employees performing operations including, but not limited to, cutting and chipping stone, etc., were exposed to sound levels which exceed the Permissible Exposure Limit (PEL) of 90 dBA as an 8-hour Time-Weighted Average (TWA). The exposures measured are equivalent to an 8-hour TWA of 94 dBA, 95.8 dBA, 96 dBA, 94.4 dBA, and 97.7 dBA. Zero exposures were assumed for all unsampled time periods.   The violation occurred on August 17, 2022.

29 CFR  1926.1153(c)(1):Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  (a) DM Sabia & Company, Inc. Jobsite located at 1 N. 19th Street Philadelphia, PA 19103. Employee worked outdoors over four hours performing stone cutting activities using a handheld power saw such as Husqvarna ring saw Model K970, Husqvarna circular saw Model K770, etc. and was not required to wear a respirator with a minimum APF10. The employer did not ensure that the employee was wearing a respirator as required by Table 1 Specified Exposure Control Methods When Working with Materials Containing Crystalline Silica.  The violation occurred on August 17, 2022.

The employer did not ensure that all employees received medical evaluations prior to the required use of N95 filtering facepiece respirators.  Employees are required to wear N95 filtering facepiece respirators as outlined in Table 1- Specified Exposure Control Methods When Working with Materials Containing Crystalline Silica.   The violation occurred on August 17, 2022.
