29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  On or about August 17, 2022 the employer JD Custom Designs, LLC at jobsite located at 4452 Bellow Rd. Lorain OH 44053, did not have an accident prevention plan or a program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as cave-in and struck-by hazards during job site operations, decreasing the probability of employee injury or illness.

29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  On or about August 17, 2022 the employer JD Custom Designs, LLC at jobsite located at 4452 Bellow Rd. Lorain OH 44053, the employer did not ensure the excavation in which an employee was working was inspected by a competent person at the beginning of each workday and throughout the shift. The need for adequate and effective cave-in protection was not evaluated or recognized prior to permitting employees in an excavation.

29 CFR  1926.652(a)(1) :Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  On or about August 17, 2022 the employer JD Custom Designs, LLC at jobsite located at 4452 Bellow Rd. Lorain OH 44053, the employer failed to ensure employees were adequately protected from cave-in hazards while performing residential sewer line installation activities in approximately an 11 ft. or deeper excavation.
