29 CFR 1910.120(q)(3)(iv): Employees engaged in emergency response and exposed to hazardous substances presenting an inhalation hazard or potential inhalation hazard shall wear positive pressure self-contained breathing apparatus while engaged in emergency response, until such time that the individual in charge of the ICS determines through the use of air monitoring that a decreased level of respiratory protection will not result in hazardous exposures to employees. a. On August 22, 2022, for operators and other employees who responded to a chemical release in the Solid Processing Pits at the facility, the employer did not ensure that the responding employees wore positive pressure self-contained breathing apparatuses or used air monitoring to determine the level of hydrogen sulfide in the air to ensure appropriate respiratory protection for the responding employees. None of the responding employees wore any respiratory protection.

As of August 22, 2022, for operators and other employees who processed solid wastes in the Solid Processing Pits at the facility, the employer did not ensure that appropriate surveillance was maintained of the work area conditions and degree of employee exposure or stress in that they did not continuously monitor the atmosphere for hydrogen sulfide exposures. There was a potential for the release of hydrogen sulfide gas during solid waste treatment operations.

29 CFR 1910.134(k)(5)(ii): Retraining was not conducted when inadequacies in the employee's knowledge or use of the respirator indicated that the employee did not retain the necessary training or skill: (a) Envirite of Ohio, Inc. DBA US Ecology, on or about August 22nd, 2022, and at times prior, at the location of 2050 Central Ave SE, Canton, OH 44707: The employer required employees to wear respirators when working in the area known as the solids processing unit (SPU) but did not ensure that retraining was conducted when employees were observed routinely not using the respirators as required. The employer did not ensure the use of appropriate respiratory protection for employees potentially exposed to dangerous levels of hydrogen sulfide gas.

As of August 22, 2022, for operators and other employees who processed solid wastes in the Solid Processing Pits at the facility, the employer did not conduct an annual evaluation of the workplace to ensure that the provisions of the current written respiratory protection program were being effectively implemented and that it continued to be effective. Operators were allowed to work in the Solid Processing Pits without wearing effective respiratory protection to protect them from potential exposures to hazardous chemicals generated from the treatment processes including hydrogen sulfide gas.
