OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not ensure that employees accessed the roof of a single family home by safe and acceptable means. (a) On or before 7/28/22 the employer did not ensure that employees riding a pallet on a rough terrain forklift were protected from fall hazards. Employees used the rough terrain forklift for personnel access and to deliver plywood sheathing to the roof of a single family home under construction. Abatement Note: Abatement certification and documentation are required for this item.

29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were made without the manufacturer's written approval: (a) On or before 7/28/22 the employer did not ensure that the attachment used to deliver personnel and materials to the roof of a single family home under construction was approved by the manufacturer. The platform was not labeled with its capacity and intended use. The platform was not secured to the mast and had begun to slide off the tines of the rough terrain forklift. These conditions exposed employees to fall hazards and struck-by hazards. Abatement Note: Abatement certification and documentation are required for this item.

29 CFR 1926.602(c)(1)(viii): A lift truck, equipped with vertical only, or vertical and horizontal controls elevatable with the lifting carriage or forks for lifting personnel, did not have the following precautions to include (A) Use of a safety platform firmly secured to the lifting carriage and/or forks (B) Means whereby personnel on the platform can shut off power to the truck (C) Protection from falling objects as indicated necessary by the operating conditions: (a) On or before 7/28/22 the employer did not ensure that the steel platform used to deliver personnel and materials to the roof of a single family home was secured to the mast, equipped with a power shutoff switch. This condition exposed employees to fall hazards. Abatement Note: Abatement certification and documentation are required for this item.
