29 CFR 1910.134(c)(2)(ii): In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks).  On or about August 31, 2022, at an establishment located at 312 Northland Ave Appleton, Wisconsin; the employer did not establish and implement a written respiratory protection program when tight-fitting half-face elastomeric respirators were provided for voluntary use to employees removing household items due to customers moving, selling items, or fire/water damage.  Appropriate provisions of 29 CFR 1910.134(c) through (m) shall be contained in a written respiratory protection program. Key elements for a voluntary respiratory use program include, but are not limited to the following:  1) Medical evaluations 2) Training on maintenance, use, and care of respirators 3) Program evaluation 4) Recordkeeping

The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  On or about August 31, 2022, at an establishment located at 312 Northland Ave Appleton, WI; the employer did not provide medical evaluations to employees to determine the employee's ability to use a respirator prior to employees voluntarily using half-face tight-fitting elastomeric respirators when removing household items due to customers moving, selling items, or fire/water damage.

The training must be comprehensive, understandable, and recur annually, and more often if necessary. This paragraph also requires the employer to provide the basic information on respirators in Appendix D of this section to employees who wear respirators when not required by this section or by the employer to do so.  On or about August 31, 2022, at an establishment located at 312 Northland Ave Appleton, Wisconsin; the employer did not provide the basic information on respirators in Appendix D of this section to employees prior to employees voluntarily wearing tight-fitting half-face elastomeric respirators while removing household items due to customers moving, selling items, or fire/water damage.

29 CFR  1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about August 31, 2022, at an establishment located at 312 Northland Ave Appleton, WI;  the employer did not ensure that each employee operating the Toyota Model 8FGU25 Forklift Truck was competent to operate the powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation required, exposing employees to struck by hazards.

29 CFR  1910.132(d)(2):The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  On or about August 31, 2022, at an establishment located at 312 Northland Ave Appleton, WI; the employer could not verify that a workplace hazard assessment has been performed.  The employer had assessed the workplace and determined that safety glasses, hard hats, gloves, and hi-vis vests were necessary for the safety of employees, but could not provide a signed, written certification of the assessment.
