29 CFR  1910.23(c)(11): The employer did not ensure that portable ladders used to gain access to an upper landing surface that have side rails that extend at least 3 feet (0.9 m) above the upper landing surface.   On or about August 31, 2022 at the entrance drive of the facility, an employee was exposed to a fall hazard using a Werner extension ladder to access the top of a sign without the ladder being extended at least three above the landing surface.

29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  On or about August 31, 2022 at the entrance drive of the facility, an employee was exposed to a fall hazard exceeding 4 feet while performing work on top of a sign without a fall protection system.
