29 CFR  1926.102(a)(1):Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:   a) Residential Site: On or about 8/29/2022, and at times prior, the employer exposed employees to struck-by hazards, in that they were operating Metabo HPT pneumatic nail gun(s) without eye protection while performing roofing activities.

29 CFR  1926.302(b)(5): The manufacturer's safe operating pressure for hoses, pipes, valves, filters, and other fittings were exceeded.  a) Residential Site: On or about 8/29/2022, and at times prior, the employer exposed employees performing roofing activities to struck-by hazards, in that they were operating a Metabo HPT pneumatic nail gun(s) at 125psi. This was above the 120 psi maximum range of the nail gun.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Residential Site: On or about 8/29/2022, and at times prior, the employer exposed employees to fall hazards of more than 17 feet above ground level, in that a complete fall protection system was not provided to employee(s) while they were performing roofing activities on a 10:12 pitch roof.
