29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  a) Drummond Framing, Inc., located at 38 E 21st Street, New York, NY 10010- Tenth floor/Spray Booth 1, 2 and Wood shop  Employees fabricating frames using hazardous chemicals were required to wear half face tight fitting respirators; however, the employer did not provide medical evaluations by a physician or licensed health care professional (PLHCP) to qualify employees to wear respirators.  Condition observed on or about September 2, 2022.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19(d)(1).

29 CFR  1910.134(f)(2): Employee(s) using a tight-fitting facepiece respirator were not annually fit tested:  a) Drummond Framing, Inc., located at 38 E 21st Street, New York, NY 10010- Tenth floor/Spray Booth 1, 2 and Wood shop  Employees fabricating frames using hazardous chemicals were required to wear half face tight fitting respirators; however, the employer failed to implement fit test for employees wearing half face tight-fitting facepiece respirators during painting and finishing operations.  Condition observed on or about September 2, 2022.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19(d)(1).

29 CFR  1910.134(k):The employer did not provide comprehensive, understandable training which did not occur annually and/or more often if necessary:  a) Drummond Framing, Inc., located at 38 E 21st Street, New York, NY 10010- Tenth floor/Spray Booth 1, 2 and Wood shop  Employees fabricating frames using hazardous chemicals were required to wear half face tight fitting respirators; however, the employer did not did not provided employees with initial or annual respiratory protection training to ensure proper use of the respirators and to inform employees on the respiratory hazards to which they are exposed.  Condition observed on or about September 2, 2022. 29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Drummond Framing, Inc., located at 38 E 21st Street, New York, NY 10010- Tenth floor   Throughout the facility, employees design and manufacture custom frames beginning with cutting, sanding, molding, painting and finishing of materials such as but not limited to wood. In these processes, employees were  exposed to hazardous chemicals including but not limited to patching compounds containing xylene, paints such as but not limited to N5471X Regal Select Premium interior paint and primer containing titanium dioxide, limestone, silica amorphous and diatomaceous earth, finishing products containing ethanol, butanol and isopropyl for the customization of frames.  The employer did not provide adequate safety training and information on the hazards of these chemicals.  Condition observed on or about September 2, 2022.
