29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) On or about September 6, 2022, employees were exposed to respiratory hazards from chemicals such as, but not limited to; Methyl Ethyl Ketone, Acetone while using these chemicals in various phases of the plumbing process. The employer did not provide medical evaluations to employees required to use the respirators as required in 1910.134(c)(1)(ii). (b) On or about September 6, 2022, employees were exposed to respiratory hazards from chemicals such as, but not limited to; Methyl Ethyl Ketone, Acetone while using these chemicals in various phases of the plumbing process. The employer did not provide fit testing procedures for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iii). (c) On or about September 6, 2022, employees were exposed to respiratory hazards from chemicals such as, but not limited to; Methyl Ethyl Ketone, Acetone while using these chemicals in various phases of the plumbing process. The employer did not provide procedures for proper use of respirators in routine and reasonably foreseeable emergency situations for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iv). (d) On or about September 6, 2022, employees were exposed to respiratory hazards from chemicals such as, but not limited to; Methyl Ethyl Ketone, Acetone while using these chemicals in various phases of the plumbing process. The employer did not provide procedures for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators of employees required to use the respirators as required in 1910.134(c)(1)(v). (e) On or about September 6, 2022, employees were exposed to respiratory hazards from chemicals such as, but not limited to; Methyl Ethyl Ketone, Acetone while using these chemicals in various phases of the plumbing process. The employer did not provide training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations for employees required to use the respirators as required in 1910.134(c)(1)(vii). (f) On or about September 6, 2022, employees were exposed to respiratory hazards from chemicals such as, but not limited to; Methyl Ethyl Ketone, Acetone while using these chemicals in various phases of the plumbing process. The employer did not provide training on putting on, removing, or the limitations of the respirators for employees required to use the respirators as required in 1910.134(c)(1)(viii). (g) On or about September 6, 2022, employees were exposed to respiratory hazards from chemicals such as, but not limited to; Methyl Ethyl Ketone, Acetone while using these chemicals in various phases of the plumbing process. The employer did not establish work-site specific procedures to regularly evaluate the effectiveness of the program as required in 1910.134(c)(1)(ix).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) On or about July 26, 2022 employees had not been provided effective information and training on hazardous chemicals in their work area. Employees were unaware of the location of safety data sheets, and required personal protective equipment associated with the use hazardous chemicals, including information associated with hazards such as, but not limited to, methyl ethyl ketone (MEK), Acetone, ABS pipe glue and/or cement, and PVC primer.
