29 CFR  1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  140 Bethany Road, Monson, MA:  On September 9, 2022 and at times prior, employees operated  A Mitsubishi fork truck # 5, Model FGC45KC, serial # AF87A00233  that was equipped with a fork attachment that was not factory installed. The data plate on the truck showed four foot forks as the approved attachment; however, eight foot forks were installed and being utilized. The truck data plate was not marked to identify these eight foot forks and did not show updated truck weight and load capacities.

On or about September 7, 2022,  the dockboard's  capacity was exceeded and failed during use,  resulting in the breakage of the securing pins.

29 CFR  1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition.  140 Bethany Road, Monson, MA:  On September 9, 2022 and at times prior, employees operated four powered industrial trucks that were defective and in need of repair and that were not removed from service until restored to safe operating condition.  (a) Mitsubishi fork truck # 5, Model FGC45KC, serial # AF87A00233, had a back up alarm that was very faint and inaudible and had bald tires with large chunks of the tire missing. (b) Mitsubishi fork truck # 7, model #, and serial # unreadable on data plate, had a horn which did not function when depressed, seatbelt was inoperative, and large chunks of the tires were missing.  (c) Hyster fork truck # 16, Model # SB0XLBCS, serial # D004D03127T, had no back up alarm, horn did not function when depressed, and emergency brake did not work. (d) Hyster 155 fork truck, had a broken load backrest on right side of assembly.
