OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by wood building components in the event of structural collapse: (a) Garage section of newly constructed building; On or about September 7, 2022, adequate bracing was not provided for the trusses and walls of the newly constructed 112 foot long by 80 foot wide garage area of a building while 80 foot long metal plate connected wood trusses were being installed atop 16 foot tall wooden framed walls. Employees of Oevering Homes LLC were exposed to hazards of being struck by building components when walking beneath the previously set trusses of the garage area and other employees were exposed to struck by hazards while performing truss setting operations on the garage area prior to and during the structure collapse.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) Garage section of newly constructed building; On or about September 7, 2022, Hardhats (protective helmets) were not worn by employees who were exposed to overhead hazards of falling tools and materials during truss setting operations.
