29 CFR  1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a)Denis Amaya Hernandez Contracting dba Denis Amaya at 4600 and 4602 Key Avenue, Sioux Falls, SD 57106: On or about and at times prior to September 14, 2022, the exposing employer did not ensure employees were protected from fall hazards by use of an effective fall protection system when performing roofing work on a residential duplex. This exposed employees to fall hazards greater than six feet.   Denis Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1531885, citation number 1, item number 1 and was affirmed as a final order on August 19, 2021 with respect to a workplace located at 501 East St. Joseph, Rapid City, SD 57701.
