29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a) On or about 9/15/2022 at a new build site located at 78 Robinson Rd Tonawanda , NY; employees were exposed to a fall hazard while framing and sheathing a commercial building . Employee was standing on the top plate of a wall on the front of the building at approximately 15 feet above ground. There were no fall protection measures in place.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about 9/22/2022 at the roof area of the site, side rails of the extension ladder extended 1.5 feet below the upper landing surface being accessed. Employee was exposed to falls.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purpose for which they were designed:  a) On or about 9/15/2022 employees were exposed to a fall hazard while working at a new commercial building project located at 79 Robinson Rd Tonawanda, NY. Employees were accessing the roof with 6 foot step ladder that was not opened and braced.   NO ABATEMENT CERTIFICATION REQUIRED
