29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) Warehouse Area - On or about September 16, 2022, the employer did not ensure an energy control program consisting of an energy control procedure, employee training and periodic inspections was established for employees performing service and maintenance on machines including, but not limited to, dismantlers, table saws, and knotchers.  The employees were thereby exposed to hazards associated with moving parts.

On or about September 16, 2022, employees were exposed to stuck-by hazards, when required to operate Toyota Forklift, Model 52-6FGU25, and Serial No. 74358. The power industrial vehicle had a functioning factory equipped seatbelt,  and was not removed from service.

29 CFR  1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent.   a) On or about August 1, 2022, a recordable injury occurred when an employee was struck in the leg by a nail after the nail gun fell to the floor and fired off a nail. The employee sustained a leg injury. The employee was taken to the hospital and released.  The employer did not record the injury on an OSHA 301 Incident Report, an OSHA Form 300 or their equivalent forms.
