On or about September 16, 2022, and at times prior thereto, employees were laying cement and bricks from a scaffold without using hard hats, exposing employees below to being struck by equipment and materials from above.

On or about September 16, 2022, employees were working from a scaffold without guardrails provided at the open sides and ends, exposing employees to hazards such as falling approximately 12 feet.

29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces was not between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a toprail crossing point of two braces were not between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. The endpoints at each upright were more than 48 inches (1.3 m) apart. On or about September 16, 2022, employees were were laying brick and cement to a residential home under new construction from a scaffold where midrailing was not used. Crossbracing was between 38 inches and 48 inches, exposing workers to a fall hazard of approximately 10 feet to the ground below.

29 CFR 1926.451(h)(1): In addition to wearing hardhats each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, or guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling object. On or about September 16, 2022, employees were laying bricks and cement while working on different levels of a scaffold with other employees working above without additional protection such as toeboards provided, exposing employee to being struck by tools and materials from above.
