29 CFR  1910.132(a):Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  a) On or about August 15, 2022 employer did not ensure that employees were provided with the required personal protective equipment for cleaning, such as face shield or safety goggles/ glasses, protective apron, and fryer gloves,  while performing a grease change out in the UltraFryer.     b) On or before August 15, 2022,  the employer did not make the proper repairs to the grease removal system to protect employees from handling the grease without proper PPE.  The system is a self contained system that pumps the fryer oil from the fryer through enclosed metal lines and out of the building, where it is collected in a tank.  Lines on the outside of the building were broken and/ or missing, causing employees to use plastic jugs to remove the grease from the fryer.

A) On or about August 15, 2022, adequate first aid treatment was not provided, nor was the hospital located in near proximity used for 10 minutes (Kettering Health Dayton Hospital/ Grandview Medical Center) for the treatment of an employee who was burned with hot fryer grease.    B) On or about August 15, 2022, the employer did not ensure that first aid supplies were readily available in that there was no first aid kit containing burn supplies was at the facility.
