Penalty
Initial $5801.00 · Current $3481.00 Reduced
29 CFR 1926.350(a)(10): Oxygen cylinders in storage were not separated from fuel-gas cylinder or combustible materials (especially oil or grease), a minimum distance of 20 feet or by a noncombustible barrier at least 5 feet high having a fire-resistance rating of at least one-half hour. (a) Tool trailer parked on North side of building 6730. On or about 9/26/2022, and at times prior, the employer exposed employees to fire and explosive hazards, in that Oxygen and Acetylene tanks were not properly stored while employees routinely used the same trailer for cutting pipe and for the storage of tools and materials. The OSHA Standard Interpretation dated May 8th, 2006 does allow for a de minimis violation when only a single oxygen and acetylene cylinder are stored together, but that interpretation requires that the tanks be closed and capped, or have properly working regulators in place.
